Vehicle Code 21107.8 (Private Road Traffic Enforcement)

Allows certain Vehicle Code traffic provisions to be enforced on private roads within specified developments, such as gated communities.

Vehicle Code section 21107.8 and related sections allow specified Vehicle Code provisions to apply on private roads within a residential development, mobile home park, or other qualifying private road system, generally requiring the road to be held open for use by owners, tenants, and their guests. This allows a level of traffic regulation (speed limits, stop sign compliance, etc.) even though the road is not publicly owned.

Gated communities, large apartment complexes, and HOA-governed developments in the Sacramento area rely on this framework to justify posted speed limits, stop signs, and traffic calming enforced in coordination with local law enforcement, since without it the applicability of ordinary traffic law to private roads would be less clear. Security patrol often supports these efforts through observation and reporting rather than direct enforcement.

Security officers do not issue traffic citations; enforcement under this statute remains with law enforcement or, in some contexts, code compliance mechanisms established by the HOA. Security staff's contribution is typically limited to reporting reckless driving, posting/maintaining required signage, and documenting incidents for the association's records.
