Civil Code 51 (Unruh Civil Rights Act)

Prohibits business establishments, including their security staff, from arbitrarily discriminating against customers based on protected characteristics.

The Unruh Civil Rights Act, codified at Civil Code section 51, guarantees all persons within California full and equal accommodations, advantages, and services in all business establishments regardless of characteristics such as sex, race, color, religion, ancestry, national origin, disability, and other protected categories, and case law has extended its reach to arbitrary discrimination generally. It applies to retail stores, apartment communities, and other businesses that engage security services.

Security officers enforce access and trespass rules on behalf of businesses, which means their day-to-day judgment calls — who gets stopped, questioned, or asked to leave — can create Unruh Act exposure for the client if those decisions are applied in a discriminatory or inconsistent manner. Consistent, criteria-based enforcement (e.g., enforcing a dress code or loitering policy the same way for everyone) is the practical defense against such claims.

Security companies should train officers to apply property rules uniformly, document the specific rule violation relied upon for any stop or removal, and avoid profiling based on protected characteristics; supervisors should audit incident reports periodically for patterns that could suggest disparate treatment. This is as much a training and quality-control issue as a legal one.

Unruh Act case law is extensive and continues to develop; verify current interpretations and consult counsel when designing access-control or enforcement policies that could implicate protected classes.
